Description:
Plaintiffs, who consist of an oystermen group and an environmental nonprofit filed suit challenging the Army Corps’ authorization of the Mid-Barataria Sediment Diversion, a coastal restoration project in Louisiana, claiming that the degraded water quality in the river along with project changes in salinity would adversely impact oysters, oyster reefs, and other protected species in the surrounding Barataria Bay. It also challenges the U.S. Fish and Wildlife Service and National Marine Fisheries Services’ concurrence with Army Corps findings that the project would not adversely impact species protected under the Endangered Species Act and Marine Mammal Protection Act.
